A. Cancellation Policy

Introduction

Consumers have a right of cancellation in accordance with the following provisions, whereby a consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor related to their independent professional activity:

Right of Cancellation

 

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day on which you, or a third party other than the carrier and indicated by you, acquire physical possession of the last good.

To exercise your right of withdrawal, you must inform us (Hyapur Deutschland GmbH, Europarc, Teerofendamm 3, 14532 Kleinmachnow, Germany, Tel.: 03030111850, E-Mail: hello@hyapur.de) of your decision to withdraw from this contract by means of an unequivocal statement (e.g., a letter sent by post or an e-mail). You may use the attached model withdrawal form for this purpose, but it is not mandatory.

You may also exercise your right of withdrawal online via the website at https://hyapur.de/en/apps/widerruf. If you use this online function, we will communicate to you without delay an acknowledgement of receipt of such a withdrawal on a durable medium (e.g., by e-mail), including information on the content of the withdrawal declaration as well as the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

 

Consequences of withdrawal

If you withdraw from this contract, we will reimburse all payments received from you, including delivery costs (excluding any additional costs arising from your choice of a delivery method other than our standard, least expensive delivery option), without undue delay and at the latest within fourteen days from the day on which we receive your notification of withdrawal from this contract. For this reimbursement, we will use the same means of payment that you used for the original transaction, unless expressly agreed otherwise; in no case will you be charged any fees as a result of this reimbursement. We may withhold reimbursement until we have received the goods back or you have supplied evidence of having sent back the goods, whichever is the earliest.

Consequences of withdrawal

You must return or hand over the goods to us without undue delay and in any event no later than fourteen days from the day on which you notify us of your withdrawal from this contract. The deadline is met if you send the goods before the fourteen-day period has expired. You bear the direct costs of returning the goods.

You are only liable for any diminished value of the goods if this diminished value is due to handling of the goods beyond what is necessary to ascertain their nature, characteristics, and functioning.

Exclusion or premature expiry of the right of withdrawal

The right of withdrawal expires prematurely for contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery.

Linked/financed transactions

If you finance this contract with a loan and later withdraw from it, you are also no longer bound by the loan agreement, provided both contracts constitute an economic unit. This is particularly likely to be the case if we are also your lender or if your lender uses our services with regard to the financing. If the loan has already been disbursed to us when the withdrawal becomes effective or when the goods are returned, your lender assumes our rights and obligations under the financed contract with respect to the legal consequences of the withdrawal or return. The latter does not apply if the present contract concerns the acquisition of financial instruments (e.g., securities, foreign exchange, or derivatives). If you wish to avoid a contractual obligation as far as possible, exercise your right of withdrawal and also cancel the loan agreement if you are entitled to do so.

General Information

1) Please avoid damaging or soiling the goods. Please return the goods to us in their original packaging, including all accessories and packaging materials. If necessary, use protective outer packaging. If you no longer have the original packaging, please ensure adequate protection against transport damage by using suitable packaging. 2) Please do not return the goods to us freight collect. 3) Please note that points 1 and 2 above are not prerequisites for the effective exercise of your right of withdrawal.
